Do I qualify for bankruptcy?

Unfortunately, there are "bankruptcy mills" who do not even take the time to see if you are qualified before filing your petition for Chapter 7 or 13 bankruptcies. In many cases, these bankruptcy petitions are quickly denied. This leaves you with your original debt problems plus the cost of someone's legal "services." Dennis M. Slate, Attorney at Law has extensive experience representing individuals with severe debt problems who want proven assistance in bankruptcy matters. The attorneys at this firm have successfully helped thousands over the years and know how to accomplish the first, most important step of bankruptcy - finding out if you are eligible.

The Bankruptcy Codes were written to assist qualified individuals to be free from all or the vast majority of their debts. The basic principle is that by legally dissolving your debts, you can start anew on your finances. The courts recognize that there are circumstances which can cause a person to lose control of their financial situation and that some form a debt relief should be granted. The law provides an exact way to determine if an individual is qualified. It also prevents those who are not eligible from taking advantage of the system. This is where a knowledgeable Deer Park bankruptcy attorney from my firm can help get you started on your journey towards a debt free life.

Using the Means Test

A "means test" is the standard way given in law to find out if you are eligible to file for bankruptcy. No matter what your income is currently, the average amount you earned over the past 6 months will be calculated. Expenses such as secured debts, past due taxes or your mortgage or rent will be deducted from the average amount you earned to determine what is called "disposable income". This amount is then compared to the median income for similar households in our state. If your income is at or below the average, you will most likely be qualified to file for bankruptcy. If your income is above that level, you may still qualify but more extensive testing will be required.

My firm will see that the means test is accurately done on your behalf so that the first hurdle towards being debt-free can be overcome. In some cases, even if your income is above the median, I can present your case to the court for review and you may still be able to qualify.

The end goal of bankruptcy, to have a fresh start and being in charge of your financial future, can only be reached by successfully taking the first step.
