Using the Means Test
A "means test" is the standard way given in law to find out if you are eligible to file for bankruptcy. No matter what your income is currently, the average amount you earned over the past 6 months will be calculated. Expenses such as secured debts, past due taxes or your mortgage or rent will be deducted from the average amount you earned to determine what is called "disposable income". This amount is then compared to the median income for similar households in our state. If your income is at or below the average, you will most likely be qualified to file for bankruptcy. If your income is above that level, you may still qualify but more extensive testing will be required.
